1.1.         This Privacy Policy constitutes a part of M3TACUP Terms and Conditions and sets out the privacy and cookies policy of M3TACUP. By accessing and using our Platforms, you consent to the practices contained in this Privacy Policy. In the event of any conflict, inconsistency or conflict between this Privacy Policy and the Terms and Conditions, the Privacy Policy shall prevail. All defined terms contained in the Terms and Conditions shall apply to this Privacy Policy unless otherwise specifically stated.

 

1.2.         Please carefully read the full content of this Privacy Policy. When accessing and using our Platforms, regardless of whether or not you register for or log in to your User Account, you acknowledge, understand, and consent to all articles described in this Privacy Policy.

 

1.3.         The purpose of this Privacy Policy is to inform you of how we handle or process your personal data in accordance with the Personal Data Protection Act 2012 (“the Act”) and other applicable laws. For the purpose of the Act, the data controller is M3TACUP.

 

1.4.         By providing your personal information to M3TACUP, you consent to the collection and use of it and any other information provided to M3TACUP in accordance with this Privacy Policy. If at any time you wish to change the uses of your personal information to which you have consented, please contact us at [email protected]. 

 

1.5.         We reserve the right to update or modify this Privacy Policy from time to time. We strongly encourage you to review the Privacy Policy whenever you access or use our Platforms to stay informed about our information practices and your privacy rights and choices.

 

 

2.            Collection of Personal Information

 

2.1.         We acknowledge and agree that any personal data may be processed or otherwise used by us solely to the extent required for the use of the Platforms, the execution of your orders and the performance of any of your requests and in accordance with the applicable law on the protection of personal data. Personal data comprises any information relating to an identified or identifiable natural person (“Personal Data”). Personal Data includes, but is not limited to your name, address, e-mail address, phone number and financial details like credit card or debit card numbers.

 

2.2.         We collect, process and use the following information:

 

·     Information you give us: We collect information you provide to us over the Platforms. This may include in particular your personal information, email address, payment details or other information uploaded by you (e.g. photos, texts etc.). Your Personal Data will be kept confidential and will only be used to complete the transaction, send you our newsletter and/or provide you with other Website services.

 

·     Information from other sources: We reserve the right to request information from third-parties (e.g. credit card information services) with regard to your payment behaviour in order to be able to offer you certain payment options.

 

·     Automatic information: As soon as you visit the Platforms, we receive and save certain pieces of information, e.g. the IP address used to connect your computer to the Internet, web browser type and version, operating system, date and time of your visit, the websites you visit within our service and the website you came from if you visit our Websites via a link from a third party website. We do this to learn more about your interests and to improve our Platforms and services.

 

 

3.            Storage and Retention of Your Information

 

3.1.         If you would like to change, update or delete your personal information in our databases, you may do so through your account profile or by contacting our support. We will make reasonable efforts to comply with your request. Keep in mind, however, that there will be residual information that will remain within our databases, access logs, and other records, which may or may not contain inaccurate or outdated personal information. The residual information will not be used for commercial purposes.

 

3.2.         We will retain your information for as long as your account is active, as needed to provide you with our services or as otherwise required by law. If you wish to cancel your account or request that we no longer use your information please contact us at [email protected].

 

3.3.         Your personal data will be held and used by M3TACUP, and any third party hosting provider acting on its behalf, in order to run the event and for analysing visitor traffic with a view to improving the event experience for visitors.

 

 

4.            Transfer of Data/Disclosure

 

4.1.         Except as set forth in this Privacy Policy or when specifically agreed to by you, we will not disclose Personal Data we gather from you through your use of our Platforms to third parties. However, where applicable, your Personal Data will be sent to those companies involved in the fulfilment of your orders (e.g. financial details like credit card or debit card numbers to those companies involved in the payment transaction). We may also share your Personal Data with third party service providers that assist us with processing your Personal Data or support or help us to provide other services to you (e.g. data storage providers), but only in accordance with the purposes for which we collected the data. In case we share your Personal Data with such third party companies, we take steps to ensure that the third party companies use appropriate safeguards to protect your Personal Data. Furthermore, we share your personal information in the clearly identifiable public areas of our Platforms.

 

4.2.         We reserve the right to disclose your Personal Data as we reasonably feel is necessary to protect our systems or business, including but not limited to complying with judicial orders or with government agencies or law enforcement officials to the extent the disclosure is in accordance with applicable data protection laws. Specifically, but without limitation, we reserve the right to disclose such information or documents when: (i) you are in violation of our Terms and Conditions; (ii) you partake (or are reasonably suspected of partaking) in any infringing or illegal activity, even without a warrant or other court order; (iii) in response to court and governmental orders, (iv) in response to allegations of infringement or illegality and (v) as otherwise required by applicable laws.

 

 

5.            Security

 

The security of your Personal Information is important to us. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your Personal Information, M3TACUP cannot guarantee its absolute security and cannot accept any liability where the security of your Personal Information is compromised.

 

 

6.            Policy Towards Children

 

Our products and services are not directed to individuals under 13. We do not knowingly collect personal information from individuals under 13. If we become aware that an individual under 13 has provided us with personal information, we will take steps to delete such information. Contact us if you believe that we have mistakenly or unintentionally collected information from an individual under 13.

We, along with many other websites, make use of so-called “Cookies”. Cookies are small files that can be stored on your computer during visits to our Platforms. They are not stored on our systems. Take part in the M3TACUP Championship by following the instructions and rules given on our website. By creating a M3TACUP Account and participating in the M3TACUP Championship, you agree to be bounded by these M3TACUP Championship Terms and Conditions, the M3TAPASS Terms and Conditions, our General Terms and Conditions, and Privacy Policy.

Compete in the M3TACUP Championship by completing the following 3 Team Challenges:

 

(1) M3TAPASS  (Max achievable score: 3,000,000 pts)

The combined score of the total EXP gained from M3TAPASS of all 3 individuals in the team.

Important Rules:

  • The use of the WIRTUAL App is subjected to WIRTUAL’s Terms and Conditions.
  • Failure to comply with applicable rules for activity submissions may result to the termination of your WIRTUAL Account and subsequent disqualification in M3TACUP Championship.

 

(2) SKILL MASTER  (Max achievable score: 3,000,000 pts)

The Skill Master challenge consists of 3 activities. 

Teams will need to:

1.      Record a video of each activity.

2.      Upload the video to one of your social media accounts (Twitter, Youtube, Facebook, Instagram, TikTok) with the following hashtags: #M3TACUP #NFT11 #WIRTUAL #WORLDCUP #QATAR2022.

3.      Submit the link to a single post and input the number of juggles or passes for the completed activity.

Important Rules:

1.         Submissions of video entries to all activities can be done by any player within the team, limited to one submission per activity per week.

2.         For entries to be valid and eligible for the Prizes:

(a)    Do a shoutout at the start of the video for your team and M3TACUP.

(b)    The juggling/passing must be continuous with no interruption and has to be recorded in one single take.

(c)    For Activity 3, each player cannot exceed a consecutive of 3 touches between each pass.

(d)    Upload the video to one of your social media accounts (Twitter, Youtube, Facebook, Instagram, TikTok) with the following hashtags: #M3TACUP #NFT11 #WIRTUAL #WORLDCUP #QATAR2022.

(e)    Submit the link to the post and input the number of juggles or passes for the completed activity via your M3TACUP Account.

(f)     The Team has to input the accurate number of juggles/passes for each entry, any false submissions will result in disqualification of the team.

(g)    All entries submitted must remain visible to the public at all times for the duration of the M3TACUP Championship for the entries to be considered valid and eligible.

3.         Final M3TACUP Championship Leaderboard Ranking will be based on the entry with the highest score achieved by the team in each activity at the end of the M3TACUP Championship.

 

(3) Team M3TACUP  (First Place: 1,000,000 pts)

Submit a team video of 3 players performing football moves in sequence between teammates and possibly against opponents!

Show us your love for football, play anywhere (safe), anytime, and most importantly, have fun and be creative! 

Teams will be ranked based on the likes received for their videos!

Important Rules:

4.         Do a shoutout at the start of the video for your team and M3TACUP.

5.         Video should be kept within 3 mins of footage, one video submission per team.

6.         Upload the video to one of your social media accounts (Twitter, Youtube, Facebook, Instagram, TikTok) with the following hashtags: #M3TACUP #NFT11 #WIRTUAL #WORLDCUP #QATAR2022 for the entry to be valid and eligible.

7.         Submit the link of the post and provide a short description of the moves done in the team video.

8.         The entry submitted must remain visible to the public at all times for the duration of the M3TACUP Championship for it to be considered valid and eligible.

9.         Ranking will be based on the total likes given to participating team videos at the end of the M3TACUP Championship.

10.      There will be a base score for valid submission (500,000 pts), and a portion based on ranking.

 

Please Note:

11.      All entries shall be wholly compliant and consistent with all relevant guidelines and rules of the respective social media platforms.

12.      For the avoidance of doubt, by submitting an entry, participating in the M3TACUP Championship, you represents and warrants that the entries and any contents posted will not infringe the intellectual property, privacy or any other rights of any third party, and will not contain anything which is unlawful, libellous, racially disparaging, defamatory, obscene, harassing or threatening, and you further agrees to abide by all rules and guidelines prescribed herein, and M3TACUP reserves the right to remove or otherwise not publish any post that contravenes any of these rules and guidelines, including but not limited to:

(a)    any post, comment, photo and video which contains offensive, aggressive, denigrating, irrelevant or inappropriate language;

(b)    any post, comment, photo and video which veers away from the challenge activity and/or is otherwise not related to M3TACUP, or which appear to be spam; and/or

(c)    any post, comment, photo and video which may be obscene, defamatory, seditious, blasphemous or otherwise malicious in nature.

13.      Entries which do not comply with any applicable regulations and guidelines will be disqualified.

14.      Each week during the M3TACUP Championship Season, The top 3 teams on the weekly leaderboard shall receive prizes as follow:

15.      The M3TACUP Championship Leaderboard Ranking will be reviewed and finalised within 7 days from the end of the M3TACUP Championship Season. The top 11 teams shall receive prizes as follow:

16.      Only the 1st place to the M3TACUP Championship is guaranteed Cash Prize in BUSD.

17.      M3TACUP reserves the right to substitute alternative prizes which may not be of equivalent value at any time by giving notice on our website and/or via our social media or otherwise notifying the relevant winners.

18.      All winners will be notified via email. A winner is solely responsible for providing updated particulars (if required) to M3TACUP for the purposes of fulfilment of the Prize, and M3TACUP shall not be liable for any loss arising from any omission, error and/or default attributable to the winner. All winners will be notified within 7 days of announcing the winners.

19.      Non-cash Prizes are non-redeemable for cash and/or any other items, and are non-transferable, non-assignable and non-exchangeable.

20.      Any Prizes which are not redeemed will be forfeited. No payment or compensation whether in cash, credit or kind shall be made for any uncollected, lost, misplaced, stolen or damaged Prize.

21.      M3TACUP reserves the sole and absolute discretion to change the mechanics of the M3TACUP Championship without prior notice or reason. M3TACUP may appoint any independent party as the external auditor for the M3TACUP Championship, as it deems fit.

22.      M3TACUP has the sole and absolute discretion to determine the authenticity, eligibility and/or accuracy of the entry and its decision will be final and binding on all participants, and no correspondence will be entertained whether in relation to the above or otherwise.

23.      M3TACUP may, in its sole and absolute discretion, disqualify any entry which we consider to have been made in breach of these terms and conditions. This includes, but is not limited to, any falsification of a team’s score reflected in any part of the entry, a team’s failure to meet the eligibility criteria and/or the submission of an entry which we deem to be obscene, libellous, racially disparaging, defamatory, harassing or threatening or contains any unlawful content.

24.      M3TACUP is not responsible for any entry that cannot be processed due to any technical or operational reasons. Entries that are lost, late, misdirected, incorrect or incomplete, for any reason whatsoever, will also not be eligible for the M3TACUP Championship.

25.      M3TACUP is not responsible for any content posted by participants or for any comments made by members of the public in relation to the entries or the posted contents. All opinions and comments expressed by users of the respective social media platforms are expressed in their individual capacities and not as representatives of M3TACUP.

26.      M3TACUP takes no responsibility and assumes no liability for any user content that any user may post. You are solely responsible for your user content and the consequences of posting and publishing it.

27.      By participating in the M3TACUP Championship, you consent to and grant M3TACUP the right to publish and/or broadcast the results of the M3TACUP Championship and disclose and publish your information as may be relevant and/or necessary for the fulfilment of the Prize, on our websites, social media and any other marketing channels.

28.      The winners may be invited to participate in public relations events to generate press coverage for the M3TACUP Championship including without limitation, winners’ quotations being included in METACUP’s press releases, and winners’ attendance at prize-giving ceremonies, press conferences, and interviews.

 

Intellectual Property

29.      You agree to waive any moral rights in the entry and/or any image, video, sound file and/or any other media in any format which is embedded in and/or linked by hyperlink or URL text or otherwise in the entry (the “Media Files”), to the fullest extent possible and any moral rights that a third party may have in respect of the entry and/or any of the Media Files described above will be so waived.

30.      All promotional images produced by M3TACUP or any member of NFT11 and associated with the M3TACUP Championship, participants, winners and Prizes will be the property of M3TACUP. M3TACUP reserves the right to publicise the names of the winners on the official websites and social media of its affiliated partners.

 

Data Protection

31.      By participating in the M3TACUP Championship and/or otherwise consenting to be a part of the M3TACUP Championship,

(a)    you consents to M3TAUP collection, holding, storage, use, processing, transfer, disclosure and/or reporting (whether directly or indirectly) to any relevant third party, of your personal data and/or information provided to M3TACUP, including but not limited to, for the purposes of administering your participation, organising and promoting the M3TACUP Championship , or otherwise for purposes relating to the M3TACUP Championship; and further consents and acknowledges that your personal data and/or information (i) will also be processed in line with M3TACUP’s privacy policy; and (ii) may be used in accordance with M3TACUP’s policies, terms and conditions or notices made available by M3TACUP to him/her from time to time;

(b)    you agrees that any personal information collected by M3TACUP about you (as provided or supplied by you) can be used by M3TACUP, and also disclosed to, and used by, persons who are involved in operating or promoting the M3TACUP Championship on behalf of M3TACUP (including M3TACUP’s service providers and affiliated partners). Your personal information will not be shared with any other third party for purposes outside the operation or promotion of the M3TACUP Championship, including marketing; and

(c)    you consents to the use of your personal data for marketing purposes, including but not limited to the use of your email or mobile number to contact you about products and promotions offered by M3TACUP from time to time via SMS or multimedia messaging.

 

Miscellaneous

32.      M3TACUP reserves the right, in its sole and absolute discretion, to modify, suspend, withdraw and/or terminate the M3TACUP Championship (or part thereof) for any reason, including if a computer virus, bug, unauthorised human intervention or other cause (a “Disrupting Event“) corrupts or impairs the administration, security, fairness, judging, or proper play of the M3TACUP Championship. If the M3TACUP Championship is so modified, suspended withdrawn, or terminated, M3TACUP reserves the right to award Prizes to participating teams from among all Entries received prior to the Disrupting Event.

33.      M3TACUP may at any time vary, modify, add or delete any of these terms without prior notice or reason. M3TACUP may in its absolute discretion at any time edit or remove any posted content that, which in its opinion, breaches any of these terms or for any other reason.

34.      To the extent permitted by applicable law, you agree that M3TACUP will not be liable, under any circumstances and in any way, for any errors or omissions, loss or damage of any kind incurred as a result of your participation (or inability to participate) in the M3TACUP Championship, any posted content or the acceptance of any Prize.

35.      To the extent that M3TACUP suffers any claim, loss, damage or judgment due to your acts or omissions (including, but not limited to, your participation in the M3TACUP Championship and the posted contents or breach of any of these terms by you), you agree to indemnify and hold M3TACUP, its affiliated partners and its respective officers, employees and agents harmless.

36.      M3TACUP’s decision in all matters arising out of or in connection with the M3TACUP Championship is final and conclusive and no correspondence will be entertained.

37.      These terms and conditions are governed by and shall be construed in accordance with the laws of the Republic of Singapore and you agree to submit to the exclusive jurisdiction of the courts of the Republic of Singapore.

M3TAPASS TERMS AND CONDITIONS

Take part in the M3TACUP Challenges with your M3TAPASS by following the instructions and rules given on our website. By creating a M3TACUP Account and participating in the challenges, you agree to be bounded by these M3TAPASS Terms and Conditions, the M3TACUP Championship Terms and Conditions, our General Terms and Conditions, and Privacy Policy.

 

IIndividual Pass

Purchasing an individual pass will give you access to the M3TAPASS rewards, however, to be eligible for the M3TACUP Championship Prize Pool you will need to form or join a team with 2 other members with upgraded M3TAPASS.

 

Team Pass

As a Captain who processed the payment for a Team Pass, you may invite 2 other players to join your team via your unique Team Invitation Link. As Team Pass holders, you and your teammates will get to enjoy full access to the M3TAPASS rewards and be eligible for the M3TACUP Championship Prize Pool by completing the team challenges!

 

INSTRUCTIONS AND RULES:

1.      It is mandatory to install and use the WIRTUAL APP to gain EXP required to progress through the M3TACUP challenges.

2.      Please use the same Mobile No. to sign up for both your WIRTUAL and M3TACUP accounts in order for the results to sync.

3.      M3TACUP Challenges via the WIRTUAL APP are based on cumulative distance, steps or calories. It is not necessary to complete an entire challenge in a single session.

4.      Upon completing a M3TACUP challenge on the WIRTUAL APP you will unlock the next challenge of the same activity.

5.      The exercise results must be of activities that have occurred within 7 days of the submission date.

6.      All exercise results must be submitted to WIRTUAL through a compatible fitness tracker application, such as Strava, Garmin Connect, Fitbit, Apple Health and Map my run.

7.      Each exercise result can only be submitted once. They cannot be re-submitted, edited or tampered with. If any tampering is found, your account will be suspended immediately.

8.      Your results submissions once validated by WIRTUAL will be reflected in your M3TACUP account for earning EXP to unlock the M3TAPASS levels.

9.      The use of the WIRTUAL App is subjected to WIRTUAL’s Terms and Conditions.

10.   Purchases are non-refundable.

 

Rewards

11.   There will be base rewards available for each M3TAPASS levels, while rewards in limited quantity are given on a first-come-first-serve basis while stocks last.

12.   All rewards need to be claimed before the M3TACUP season ends, any unclaimed rewards will be forfeited.

13.   M3TACUP reserves the right to substitute alternative rewards which may not be of equivalent value at any time by giving notice on our website and/or via our social media.

14.   Non-cash rewards are non-redeemable for cash and/or any other items, and are non-transferable, non-assignable and non-exchangeable.

15.   Any rewards which are not redeemed will be forfeited. No payment or compensation whether in cash, credit or kind shall be made for any uncollected, lost, misplaced and stolen rewards.

20.   These terms and conditions are governed by and shall be construed in accordance with the laws of the Republic of Singapore and you agree to submit to the exclusive jurisdiction of the courts of the Republic of Singapore.
